Disclaimer

Foreclosure Surplus is an independent educational resource. It is not a law firm, a financial advisor, or a recovery/finder company.

Not legal or financial advice

Everything on this site is general information only. It is not legal, financial, or tax advice, and it is not a substitute for advice from a licensed professional about your specific situation. Reading this site or using our tools does not create an attorney–client or any other professional relationship.

Laws and deadlines vary and change

Foreclosure surplus and tax-sale overage rules differ by state — and often by county — and they change over time, including after court decisions such as Tyler v. Hennepin County. Any deadline, statute, or procedure described here may be outdated or may not apply to your case. Always confirm the current rules with your county clerk, trustee, treasurer, your state’s unclaimed-property office, or a licensed attorney before you act.

The “verified” label and our tool

Where our State Surplus Claim Finder marks a state as “statute verified,” we confirmed that deadline against the cited statute at the time of writing; for all other states we deliberately show only the general process and tell you to verify locally rather than guess a legal deadline. The tool is educational, runs entirely in your browser, and does not collect or transmit your information.

No guarantee

We do not guarantee that you are owed surplus funds, that any amount is recoverable, or any particular outcome. Whether funds exist and can be claimed depends on the facts of your sale, valid liens, and your state’s law and deadlines.
